Instalawyer....

Weighs in on tort reform, from a trial lawyer's perspective. Not surprisingly, malpractice insurance rates seem to be the fault of everyone except trial attorneys.

I did find some of his statements to be very interesting. For example, when describing the Columbia debris he chose the phrase:

Frankly, it's a miracle somebody didn't get knocked on the head by one of the thousands of pieces of raining disaster.

I guess "thousands of pieces of raining disaster" sounds exactly like something I would expect a trial lawyer to say.

Now, I think the issue of tort reform is huge and complicated, and probably outside the realm of expertise of most people. But I work with lots of MDs, and they are pretty much used to being carpet bombed every time a patient dies - anyone who even saw the patient get wheeled by on a gurney ends up getting sued. While the cost of malpractice insurance may not fall strictly within the realm of greedy trial lawyers, I think the number of frivolous suits looking to place blame where none exists certainly does.

But ya gotta give the guy some credit - he is battling one of the hardest PR battles I can think of, and offering us a perspective we usually don't see.

That his initial thoughts were about falling debris possibly hitting someone,.....I never went to college, but I can spell ambulance chaser. Everytime we have an execution a horde of attornies tell us we can't do it because even one mistake in a hundred is too much too tolerate, even though they haven't proved one yet. But the reverse is that for every case of a real victim getting recourse, there are a hundred false, trivial, and downright moneygrubbing lawsuits. I guess justice for a lawyer is always about money, that they keep a huge portion of.
